If you violate any part of this Terms of Use, your right to access and/or use the Service Content and Website shall automatically terminate and you shall immediately destroy any copies you have made of the Service Content.
2. Trade Marks. The Biocon Biologics name and logos are trademarks and service marks of Biocon Biologics (collectively the “Biocon Biologics Trademarks”). Other product and service names and logos used and displayed via the Website may be trademarks or service marks of their respective owners who may or may not endorse or be affiliated with or connected to Biocon Biologics. Nothing in these Terms of Use or the Website should be construed as granting, by implication, estoppel, or otherwise, any licence or right to use any of Biocon Biologics Trademarks or any other trade marks, service marks or logos displayed on the Website, without our prior written permission in each instance. The Biocon Biologics Trademarks shall not be used to disparage Biocon Biologics or the applicable affiliate or licensor, Biocon Biologics’ or third-party’s products or services, or in any manner (using commercially reasonable judgment) that may damage any goodwill in the Biocon Biologics Trademarks. Use of any Biocon Biologics Trademarks as part of a link to or from any web site is prohibited without Biocon Biologics’ prior written consent.  All goodwill generated from the use of Biocon Biologics Trademarks will inure to our exclusive benefit.

5. Misuse of The Website

1. You shall use the Website for lawful purposes only. Whether inside or outside of the United States, you are solely responsible for ensuring compliance with the laws of your specific jurisdiction. 2. Liability which we do not exclude or limit. Nothing in these Terms of Use will limit or exclude our liability to you for death or personal injury caused by our negligence, fraudulent misrepresentation, or any other liability which cannot be limited or excluded by law. Some jurisdictions do not allow the disclaimer or exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. LIMITATION OF LIABILITY. TO THE EXTENT WE ARE ALLOWED UNDER APPLICABLE LAW TO LIMIT OUR LIABILITY TO YOU, THEN OUR LIABILITY TO YOU ARISING FROM THE USE OR INABILITY TO USE, OR UNDER OR IN CONNECTION WITH, THE WEBSITE AND THE SERVICE CONTENT, WHETHER BASED ON WARRANTY, IN CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF STATUTORY DUTY OR ANY OTHER LEGAL THEORY, EVEN IF ANY Biocon Biologics PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, IS LIMITED TO £50.

LOSSES WE ARE NOT LIABLE FOR. WE WILL NOT BE LIABLE WHETHER BASED ON WARRANTY, IN CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF STATUTORY DUTY OR ANY OTHER LEGAL THEORY(TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW), EVEN IF ANY Biocon Biologics PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, FOR: (I) ANY DIRECT OR INDIRECT ECONOMIC LOSSES (INCLUDING WITHOUT LIMITATION LOSS OF REVENUES, DATA, PROFITS, CONTRACTS, USE, OPPORTUNITY, BUSINESS OR ANTICIPATED SAVINGS); (II) LOSS OF GOODWILL OR REPUTATION; OR (III) SPECIAL, INCIDENTAL OR CONSEQUENTIAL LOSS OR DAMAGE, SUFFERED OR INCURRED OR ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE WEBSITE AND SERVICE CONTENT (WHICH INCLUDES WITHOUT LIMITATION ANY ERRORS OR OMISSIONS CONTAINED IN THE WEBSITE AND THE SERVICE CONTENT, IF THE WEBSITE OR SERVICE CONTENT IS UNAVAILABLE, OR IF CHANGES HAVE MADE TO THE WEBSITE OR SERVICE CONTENT BY UNAUTHORISED THIRD PARTIES).

In such case, you agree to cooperate with any reasonable requests assisting Biocon Biologics’ defense of such matter.

We are unable to guarantee the confidentiality or security of any data passing via the Website. Accordingly, your use of the Website is at your own risk.

10. General Terms

These Terms of Use contain the entire agreement between us and you with respect to their subject matter. A person who isn’t a party to these Terms of Use has no rights under them, whether under the Contract (Rights of Third Parties) Act or otherwise.  If either we or you have any right to enforce these Terms of Use against the other, that right will not be lost even if the person who has the right delays enforcing it.  If any provision of these Terms of Use is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect.   Failure of Biocon Biologics to act on or enforce any provision of these Terms of Use shall not be construed as a waiver of that provision or any other provision in these Terms of Use.  No waiver shall be effective against Biocon Biologics unless made in writing, and no such waiver shall be construed as a waiver in any other or subsequent instance.

These Terms of Use, and any disputes arising out of or in connection with them (including non-contractual disputes), whether in contract or tort or otherwise, are governed by the laws of India, without regard to any conflict of law rules. Any legal proceedings in relation to the Website or these Terms of Use shall be subject to the exclusive jurisdiction of the courts of Bengaluru, India.
